Abstract
The purpose of this research aims to study theories, concepts, principles of human organ transplantation, legal measures for human organ trafficking, and propose and develop legal measures for human organ trafficking. The study examines issues, problems, theories, concepts, principles of human organ transplantation, legal measures for human organ trafficking, and legal problems of human organ trafficking in cases where the victim is still alive. The results of the study found that (1) Human organ transplantation has criteria for diagnosing death of a person in the case of brain death according to the Medical Council’s regulations on the maintenance of ethics in the medical profession regarding organ transplantation and blood transplantation from donors 2023. (2) It found that the determination of compensation in human trafficking cases has applied the principle of punitive compensation according to the Human Trafficking Procedure Act. (3) It found that compensation after an organ transplant is successful, returning property or using the price as compensation in a violation case. Organs of the body, such as kidneys, are not legal property.
