LEGAL PROBLEMS IN RE-OFFENDING DRUG CASES BY CHILDREN AND YOUTH

Abstract

The purpose of this research article is to study legal problems in recidivism in drug cases among children and youth. This is determined by (1) the participation of administrative staff in the areas where children and youth live (2) the determination of days and times for reporting probationers. This research is qualitative research. Study legal documents.The results of the research found that (1) Juvenile and Family Court and Juvenile and Family Court Procedure Act 2010, Section 132, paragraph one, the court ordered probation by requiring the defendant to report to the probation officer in stages. When the practice is between the offender and the probation officer only (2) Regulations of the Probation Department regarding criteria, methods, and conditions regarding probation plans and rehabilitation plans, B.E. 2017, allow probation officers to set days and times for Self-report of probationer Most use a urine test once a month, giving probationers time to reoffend.Therefore it is proposed to amend (1) the Juvenile and Family Court and  Juvenile and Family Court Procedure Act 2010 Section 132/1 “During probation according to Section 132 paragraph one administrative officials in the area where children and youth reside Also participating in the probation process By investigating and reporting to the probation officer” (2) Amending the Probation Department regulations on criteria methods and conditions regarding probation plans and rehabilitation plans B.E. 2017 Section 7/1 “In the case of an offense If you are a drug user the probation officer will set a date and time for reporting the probationer Minimum twice a week.”
