SHARING ECONOMY AND LEGAL GAPS IN THAILAND: LABOUR PROTECTION IN DIGITAL PLATFORM SYSTEMS

Abstract
This academic article aims to analyze the legal gaps in Thailand regarding Labour protection in the sharing economy, particularly in digital platforms, which have become an essential part of Thailand's rapidly growing digital economy. The use of platform-based systems has resulted in more flexible work arrangements; however, workers operating through platforms are not protected under traditional Labour laws. This article examines these legal gaps and finds that Thai laws cannot fully protect Labour in the platform economy, as the legal status of workers in platforms is not clearly defined. As a result, these workers do not receive the benefits stipulated in traditional Labour laws, such as social security and fair compensation. The study proposes five policy recommendations to develop laws that can sustainably and equitably protect workers in the new economy: improving laws to include platform workers, defining a clear legal status, granting equal welfare rights as regular workers (e.g., health insurance and protection from exploitation by platforms), establishing appropriate Labour standards for platform workers, and promoting Labour unionization to enhance workers' bargaining power.
