DNA EVIDENCE EXAMINATION IN THE CRIMINAL JUSTICE PROCESS: A COMPARATIVE ANALYSIS OF THAILAND, THE UNITED STATES, ENGLAND, AND JAPAN

Abstract
This academic article analyzes DNA evidence examination in the criminal justice process through a comparative framework involving Thailand, the United States, England, and Japan. It highlights the relationship among legal systems, truth-seeking mechanisms, biological evidence collection, DNA databases, and the admissibility of evidence in court. The article argues that DNA evidence is a powerful forensic tool for individual identification. It can link suspects to crime scenes, physical evidence, or victims, while also serving to exonerate accused persons. Nevertheless, the reliability of DNA results does not depend solely on scientific technology. It also depends on the legality of evidence acquisition, standards of collection and preservation, contamination control, interpretation of results, and mechanisms for protecting the rights of individuals whose genetic information is retained. Compared with the United States, England, and Japan, those jurisdictions provide relatively clearer legal rules or operational guidelines concerning collection authority, retention periods, deletion of profiles, and the role of expert witnesses. Thailand, by contrast, still faces legal gaps regarding a national DNA database and checks and balances during the investigative stage. The article therefore proposes that Thailand enact specific legislation on DNA databases, establish clear chain-of-custody standards, strengthen the roles of prosecutors and forensic experts, and create an oversight system that balances crime-control efficiency with human rights protection.
