LEGAL ISSUES CONCERNING THE RIGHT TO STATE-PROVIDED ATTORNEYS FOR SUSPECTS AND DEFENDANTS IN CRIMINAL PROCEEDINGS

Abstract
A Study of Legal Issues Concerning the State-Provided Right to Counsel for the Accused and Defendants in Criminal Cases Pursuant to Constitutional Intent, This study is predicated upon the constitutional framework of the Constitution of the Kingdom of Thailand B.E. 2560 (2017), interpreted in conjunction with the legislative intent of the B.E. 2540 (1997) and B.E. 2550 (2007) Constitutions. The objective is to analyze relevant legal concepts, theories, principles, and existing research, as well as international comparative perspectives, to propose solutions for issues surrounding the state’s provision of legal counsel to the accused and defendants in criminal proceedings. Furthermore, this research aims to offer practically feasible recommendations tailored to the Thai socio-legal context, utilizing a qualitative legal research methodology primarily based on documentary analysis.
The findings reveal that the 2017 Constitution does not explicitly codify the right to state-provided counsel with the same specificity as its predecessors. When examining the spirit of previous constitutions, there is a consistent trajectory of protecting the rights of the people to ensure equality and due process within the justice system. Consequently, the State must recognize the fundamental liberties regarding equal access to justice. The State should provide legal counsel to the accused or defendants equitably to safeguard fundamental rights, spanning from the period of initial detention by authorities through to the judicial trial phase. This serves as a vital guarantee for public confidence in the impartiality of the justice system. The study concludes that the Constitution should be amended to include more comprehensive and explicit provisions protecting the right to counsel. Additionally, relevant sections of the Criminal Procedure Code should be amended to harmonize with these constitutional principles, thereby fully realizing the underlying intent of the Constitution.
