THE LEGISLATIVE MEASURES ABOUT THE PROBLEM SOMETHING THE RIGHT OF THE INVESTOR AND THE ACCESSORY IN THE BORDER DEVELOPS SPECIAL THE EAST

Abstract

This research article aims to examine the rights related to the designation of areas as the Eastern Economic Corridor (EEC), the ownership of land or movable property, and the entitlement to income tax exemptions or reductions for business operators within the Eastern Economic Corridor. This study adopts a qualitative research approach, utilizing documentary research on relevant concepts, theories, and legal frameworks from both international and Thai contexts. The collected data were analyzed to identify legal measures for preventing issues arising from the acquisition of investment privileges by investors and related parties within the Eastern Economic Corridor.

          The findings reveal that the designation of areas as part of the Eastern Economic Corridor is not limited to the three provinces of Chachoengsao, Rayong, and Chanthaburi, but may be expanded to other areas, which could create problems for existing residents. Regarding property ownership, business operators—particularly foreign individuals—are permitted to own land or movable property without undergoing other legal procedures, potentially leading to increased foreign control over land and real estate, thereby posing risks to national security. Furthermore, the provision of income tax exemptions or reductions for business operators and their family members within the Eastern Economic Corridor may result in losses to the state in terms of income tax revenue collection.
