LEGAL MEASURES FOR THE PREVENTION AND SUPPRESSION OF ONLINE GAMBLING
Main Article Content
Abstract
This research aims to (1) examine the legal measures for the prevention and suppression of online gambling in Thailand, (2) analyze the problems and obstacles in law enforcement, and (3) propose recommendations for improving the relevant legal framework. This study employs a documentary research approach by reviewing academic articles, books, journals, theses, court decisions, and relevant laws from both domestic and international sources. In addition, a comparative analysis is conducted on the legal frameworks of Sweden, the Philippines, and the United Kingdom in order to assess the appropriateness of legal measures within the context of a digital society.
The findings reveal that (1) Thailand has several laws related to online gambling, such as the Gambling Act B.E. 2478 (1935), the Computer Crime Act, and the Anti-Money Laundering Act; however, these laws are not fully capable of addressing the characteristics of online gambling in the digital era. (2) Major challenges in law enforcement include the use of nominee bank accounts, concealment of financial transaction trails, online advertising through digital platforms, and difficulties in identifying offenders, as well as legal limitations, overlapping enforcement among multiple laws, and restrictions on accessing financial and telecommunications data for evidence collection. (3) The comparative study indicates that selected countries have established comprehensive legal frameworks, licensing systems, and specialized regulatory authorities, enabling systematic control of online gambling activities. Therefore, Thailand should revise its legal framework to explicitly cover online gambling, reduce legal overlap, and develop legal measures that are consistent with the digital context in order to enhance the effectiveness of prevention and suppression of online gambling in a sustainable manner.
