LEGAL CONSTRAINTS ON BENEFIT ALLOCATION FROM INTELLECTUAL PROPERTY RESEARCH AND INNOVATION MANAGEMENT AT SUAN SUNANDHA RAJABHAT UNIVERSITY

Abstract

This study aims to examine the current situation and to analyse the legal problems relating to the allocation of benefits derived from the management of intellectual property and innovation at Suan Sunandha Rajabhat University, as well as to propose appropriate legal and institutional guidelines for improvement. The research adopts a qualitative research approach, employing documentary research of relevant laws, regulations, and institutional rules, together with in-depth interviews. The analysis is conducted through a comparative legal framework, taking into account both theoretical perspectives and the specific institutional context governing the allocation of benefits from intellectual property and innovation within Suan Sunandha Rajabhat University.

The findings indicate that Suan Sunandha Rajabhat University possesses significant potential for the effective creation of intellectual property, research, and innovation. However, the commercial utilisation of such intellectual property and the subsequent allocation of benefits are constrained by complex legal limitations. In particular, multiple legal instruments simultaneously govern the allocation of benefits arising from intellectual property, resulting in diverse interpretations and legal uncertainty in practice. This lack of clarity has led to ambiguity regarding the rights and obligations of the university, researchers, and funding partners in the benefit-sharing process.

Accordingly, this study recommends that the university revise and improve its internal regulations concerning the management of intellectual property, research, and innovation to ensure greater legal clarity and consistency with the applicable legal framework, taking into account the specific context of Suan Sunandha Rajabhat University. In addition, the study emphasises the importance of fostering collaboration with the private sector for the commercialisation of intellectual property, research, and innovation through fair and clearly defined contractual arrangements. Finally, it is proposed that the university actively support the reform and modernisation of laws governing the allocation of benefits from intellectual property, research, and innovation, so as to ensure their alignment with contemporary economic and institutional realities.
