ความเงียบของกฎหมาย: สิทธิของ LGBTQ+ ในครอบครัวจีนร่วมสมัย และข้อจำกัดของนิติปรัชญาจีนดั้งเดิม

บทคัดย่อ
บทความวิชาการนี้มุ่งวิเคราะห์ปรากฏการณ์ “ความเงียบของกฎหมาย” จีนต่อสิทธิของกลุ่มบุคคลผู้มีความหลากหลายทางเพศ (LGBTQ+) ในการก่อตั้งครอบครัว โดยโต้แย้งว่าความเงียบดังกล่าวไม่ได้เป็นเพียงความล้าหลังทางกฎหมาย แต่เป็นการแสดงออกของความตึงเครียดเชิงวัฒนธรรมและอุดมการณ์ที่ฝังรากลึกในนิติปรัชญาจีนดั้งเดิม โดยเฉพาะอิทธิพลของแนวคิดขงจื๊อที่เน้นโครงสร้างครอบครัวแบบชายหญิงและการสืบทอดสายสกุล บทความนี้ดำเนินการวิเคราะห์โครงสร้างกฎหมายครอบครัวจีนปัจจุบัน รากฐานทางวัฒนธรรมของความเงียบทางกฎหมายผ่านปรัชญาขงจื๊อ และเปรียบเทียบกับแนวทางการรับรองสิทธิเสมอภาคในกฎหมายต่างประเทศ เช่น ไต้หวันและเยอรมนี เพื่อชี้ให้เห็นถึงความเป็นไปได้ทางกฎหมาย จากนั้น บทความนี้ได้สังเคราะห์แนวคิดจากขงจื๊อสมัยใหม่ สตรีนิยมจีน และหลักสิทธิมนุษยชนสากล เพื่อนำเสนอ “กรอบนิติศาสตร์ใหม่” ที่สามารถสร้างพื้นที่ทางกฎหมายให้แก่ความหลากหลายทางเพศในบริบทจีนอย่างไม่ขัดแย้ง
องค์ความรู้ของบทความนี้ ได้แก่ การตีความ “ความเงียบของกฎหมาย” ว่าเป็น “การกระทำเชิงอุดมการณ์” ของรัฐ การเสนอ “กรอบนิติศาสตร์ไตรประสาน” ที่บูรณาการขงจื๊อสมัยใหม่ สตรีนิยมจีน และสิทธิมนุษยชน เพื่อเป็นแนวทางในการปฏิรูปกฎหมาย และการมองความตึงเครียดระหว่างนิติปรัชญาดั้งเดิมกับความท้าทายร่วมสมัยในฐานะ “ความตึงเครียดเชิงสร้างสรรค์” ที่สามารถนำไปสู่การพัฒนาองค์ความรู้ทางนิติปรัชญา ภาษาและวัฒนธรรมจีน โดยสรุปว่า การสร้างสมดุลระหว่างการเคารพรากฐานทางวัฒนธรรมกับการส่งเสริมสิทธิมนุษยชนเป็นสิ่งสำคัญ และเสนอแนะแนวทางการวิจัยในอนาคตเพื่อขับเคลื่อนการเปลี่ยนแปลงต่อไป
