สิทธิแรงงานต่างด้าวในไทยยุคสมัยปัจจุบัน

บทคัดย่อ
บทความนี้มุ่งศึกษาสถานการณ์สิทธิแรงงานต่างด้าวในประเทศไทยยุคสมัยปัจจุบัน โดยวิเคราะห์จากกรอบแนวคิดสิทธิมนุษยชนสากล ทฤษฎีแรงงานข้ามชาติ และแนวคิดความยุติธรรมทางสังคม พบว่าแม้ประเทศไทยจะมีการตรากฎหมายและนโยบายหลายฉบับเพื่อคุ้มครองสิทธิของแรงงานต่างด้าว เช่น พระราชบัญญัติการบริหารจัดการการทำงานของคนต่างด้าว พ.ศ. 2560 และความตกลงความเข้าใจ (MOU) กับประเทศต้นทาง แต่ในทางปฏิบัติยังเผชิญปัญหาหลายประการ ได้แก่ การบังคับใช้กฎหมายที่ไม่ทั่วถึง ความไม่แน่นอนของนโยบาย ต้นทุนการขึ้นทะเบียนที่สูง ข้อจำกัดด้านภาษา การตีตราทางสังคม และความเสี่ยงต่อการค้ามนุษย์ บทความนี้เสนอแนวทางการส่งเสริมสิทธิแรงงานต่างด้าวอย่างยั่งยืน ได้แก่ การปฏิรูประบบกฎหมาย การลดต้นทุนการขึ้นทะเบียน การขยายการเข้าถึงข้อมูลสิทธิ การสนับสนุนบทบาทภาคประชาสังคม การเปลี่ยนแปลงทัศนคติของสังคม การเสริมสร้างความร่วมมือระหว่างประเทศ และการใช้เทคโนโลยีในการบริหารจัดการแรงงานต่างด้าว ทั้งนี้ การคุ้มครองสิทธิแรงงานต่างด้าวอย่างเป็นรูปธรรมไม่เพียงแต่ช่วยเสริมสร้างคุณภาพชีวิตของแรงงาน แต่ยังส่งเสริมเสถียรภาพทางเศรษฐกิจและภาพลักษณ์ด้านสิทธิมนุษยชนของประเทศไทยในเวทีระหว่างประเทศอีกด้วย
